1. Acceptance of Terms

By accessing and using Chaks SA, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. User Responsibilities

• You must be at least 18 years old
• You are responsible for maintaining confidentiality of your PIN and credentials
• You agree not to use the service for illegal activities
• You will provide accurate and complete information

3. Acceptable Use Policy

You agree not to:

• Engage in fraudulent or illegal transactions
• Attempt to breach our security systems
• Use the service to launder money or support illegal activities
• Harass or abuse other users

4. Transaction Terms

All transactions are subject to verification and approval. We reserve the right to refuse, cancel, or reverse any transaction that appears fraudulent or violates these terms. Transaction fees apply as displayed in the app.

5. Limitation of Liability

We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this service. Our total liability shall not exceed the transaction amount.

6. Dispute Resolution

Any disputes shall be governed by the laws of South Africa. Users agree to binding arbitration before pursuing legal action.

7. Account Suspension

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk.

8. Financial Services Disclaimer & Licensing

⚠️ Important:

• Chaks SA is a registered Technology Partner of OTT Mobile Technologies (Pty) Ltd, a licensed South African technology company. All services are facilitated under OTT Mobile's regulatory framework.
• OTT Voucher Deposits, ZESA Electricity Payments, DSTV payments, South African & Zimbabwean airtime, and money transfers are processed through OTT Mobile's licensed infrastructure.
• International airtime top-ups to 170+ countries are facilitated through licensed global airtime infrastructure. These transactions are subject to applicable exchange rates and are non-refundable once processed.
• Chaks SA acts as a technology partner/reseller — user funds are managed by OTT Mobile Technologies (Pty) Ltd, not held directly by Chaks SA.
• All transactions are subject to OTT Mobile's terms, as well as South African FICA, POPIA, and Consumer Protection Act compliance.
• Transaction fees are non-refundable. Voucher PIN purchases cannot be reversed.
• Users must be 18 years or older to use this platform.

9. Refund & Dispute Policy

• OTT Vouchers: Non-refundable after PIN issuance. Disputes must be reported within 48 hours via WhatsApp.
• Failed Transactions: If payment is deducted but service not received, contact us within 24 hours. We will investigate and initiate refund within 5-7 business days.
• Service Issues: For failed ZESA, DSTV, or airtime transactions, we will provide proof or issue a credit.
• International Airtime: Non-refundable once processed. In case of a technical failure, report within 24 hours and we will investigate.
• All disputes are subject to verification against third-party provider records.

10. Risk Acknowledgment

You acknowledge that financial transactions carry inherent risks. Chaks SA is not liable for market fluctuations, service provider delays, currency exchange losses, or variations in international airtime values due to operator pricing changes. International airtime amounts may differ from the ZAR equivalent displayed at the time of purchase. Use this platform at your own risk.
